Please do not attend tennis if you are feeling sick or unwell. Wash hands prior to and post classes. If you have a weakened immune system or are in any other government high-risk category please consider this before booking.

I understand that tennis is a physical sport and that there is risk of injury involved in participating in the activity. I authorise any representative of Nicole Arendt's (via Game Face) and Wentworth Falls Tennis Clubs to use and disclose the medical information provided to Nicole Arendt (or her agents) to obtain any medical assistance, treatment and transportation for me or my child, as deemed reasonably necessary. I consent to any such medical treatment and/or transportation. I acknowledge and agree that I will be responsible for any costs associated with such medical treatment and/or transportation.

In considération of me or my child participation in the Activity, to the fullest extent permitted by law, I release and agree to, indemnify, defend and hold harmless Nicole Arendt and her employees (via Game Face) and Wentworth Falls Tennis Clubs from and against any injury, loss damage actions, proceedings, claims demands, expenses (including legal expenses), damages and liabilities howsoever arising from or incurred as a result of or in connection with my child's participation in the Activity.

I hereby consent to myself, my son or my daughter/ward being photographed/filmed/interviewed by Nicole Arendt's (va Game Faces)/Wentworth Falls Tennis Club's promotional events/activities. I understand this could include (but not limited to ) distribution to talent's (myself/son/daughter/ward) image on the Game Faces website, general exhibition at school events; television, print and electronic media and other associated promotional materials.  If you have a problem with this, please email Nicole at nicole-arendt@bigpond.com.

I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in tennis activities or workshops. I understand that it is my responsibility to consult with a doctor prior to and regarding my participation in tennis activity. With regard to my child, I represent and warrant that any medical conditions have been disclosed on the enrolment form for said Activity at the time of enrolment.

I understand that all personal and health information provided by me to Nicole Arendt (Game Faces) is kept strictly private and confidential and not is disclosed to any person or third party without my consent. I understand also that my contact information is kept confidential and is not shared or sold to third parties.

I understand that I may receive email communications and SMS messages from time to time, either in direct relation to the fitness activity or sessions that I have signed up for, or in relation to other Nicole Arendt (Game Faces) tennis program, related information, special offers and class schedules.

I, my heirs or legal representatives forever release waive, discharge and covenant not to sue Nicole Arendt (Game Faces) or any instructor, consultant or representative of Nicole Arendt for any injury or death caused by negligence or other acts.

I understand that all classes require minimum numbers to go ahead. Cancellations for group or private lessons within 24hours of starting the course/lesson will incur a cancellation fee equivalent to the full fee for the course/lesson.

 

With respect to enrolling in Cardio Tennis classes, the following specific terms and conditions apply.

1. I understand the nature and the purpose of Cardio Tennis and I am aware
   that any strenuous physical activity involves certain risks. I assume the
   risk of any and all accidents or injuries of any kind, which may be sustained by me by reason of, or in connection with, my participation in Cardio Tennis. I release, discharge and absolve the Coach and the Club and each of their officers, directors, employees, volunteers and agents from any and all liability or responsibility for any such accident or injury except to the extent that such accident or injury is caused by or results from any negligent act or omission of the Coach or the Club or any of their officers, directors, employees, volunteers and/or agents. This release shall be binding upon my heirs, executors, administrators and assigns. 

2. While participating in Cardio Tennis, I agree to abide by the Coach’s instructions at all times. 

3. In the event of an emergency, I authorize the performance of first aid or medical treatment by trained personnel. 

4. Photographs or video may be taken and used for display or Internet purposes related to the program/club. Permission is not required for participation. Please indicate whether or not you consent to photographs or video of you being taken at the Cardio class at Wentworth Falls Tennis Club:

Under the Australian Consumer Law several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that Tennis Australia, Tennis NSW and the Deliverer (Nicole Arendt) are required to ensure that the recreational services we supply to you are rendered with due care and skill; and are reasonably fit for any purpose which you, either expressly or by implication, make known to the us; and might reasonably be expected to achieve any result you have made known to the us. Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, we are entitled to ask you to agree that these statutory guarantees do not apply to you. If you sign this waiver and release form, you will be agreeing that your rights to sue us under the Australian Consumer Law and Fair Trading Act 2012 if you are killed or injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form.
NOTE: The change to your rights, as set out in this form, does not apply if your death or injury is due to gross negligence on our part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
